Welcome to APS Automotive Inc (“APS Automotive,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, digital platforms, and automotive repair, maintenance, and smog inspection services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.
1. Overview
APS Automotive Inc is a full-service automotive repair and maintenance shop located in Atascadero, California. We provide smog testing and repair, oil changes, computer diagnostics, general repair, and maintenance services for cars, trucks, SUVs, and RVs. We are a California state-licensed smog test and repair facility and have been serving the community since 1992.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use our Services. By accessing or using our Services, you represent that you are the vehicle owner or are authorized to act on behalf of the vehicle owner, and that you will use the Services only for lawful purposes in accordance with these Terms.
3. Service Scope
APS Automotive provides automotive repair and maintenance services, which may include smog testing and repair, oil changes and fluid services, computer diagnostics, brake and suspension repair, and online appointment scheduling. Specific services, timelines, and fees will be discussed and agreed upon prior to the start of any work. Written estimates will be provided as required by California law.
4. Payments
Payment is due upon completion of services unless otherwise agreed in writing. We accept major credit cards, debit cards, and cash. We will provide a written estimate before beginning work. If additional repairs are needed beyond the original estimate, we will contact you for authorization before proceeding. Overdue invoices may incur additional fees. Vehicles may be held pursuant to a mechanic’s lien under California law until payment is received.
5. Client Responsibilities
You agree to provide accurate vehicle information including year, make, model, and known issues; authorize repairs before work is performed; pick up your vehicle in a timely manner after services are completed; and comply with all applicable laws regarding vehicle registration, emissions, and roadworthiness.
6. Warranties and Guarantees
Warranty terms vary by service and parts used. Specific warranty information will be provided at the time of service. Warranty coverage applies to the specific repair performed and does not extend to unrelated components or pre-existing conditions.
7. Online Scheduling and Communications
Appointment requests submitted online are not confirmed until you receive confirmation from our team. Automated reminders are provided as a courtesy and may not always be delivered due to carrier or technical issues. You are responsible for confirming appointment details directly with our shop.
8. SMS Notifications and Messaging
We may send SMS notifications, appointment reminders, and service updates to customers who have opted in. You can cancel the SMS service at any time by texting “STOP.” Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Message and data rates may apply. Message frequency varies. For questions about your text plan, contact your wireless provider.
9. Confidentiality
Both parties agree to maintain confidentiality regarding proprietary information shared during the course of services. Confidential information will not be disclosed to third parties without written consent unless required by law.
10. Limitation of Liability
To the fullest extent permitted by law, APS Automotive shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of revenue or data. Our total liability for any claim shall not exceed the total amount paid by you for the specific service giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless APS Automotive Inc, its owners, employees, and affiliates from any claims, liabilities, or expenses arising from your use of the Services, breach of these Terms, or violation of applicable laws.
12. Termination
Either party may terminate the service relationship at any time. If services are terminated mid-repair, you are responsible for payment of any work completed, parts ordered, or expenses incurred prior to termination.
13. Changes to These Terms
APS Automotive reserves the right to update or modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Services after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes will be resolved in the courts located in San Luis Obispo County, CA.
